*Detection of treatment for jadeite: GFCO can only check if the jadeite is dyed or not. Bleaching treatment may not be detected. Thus, GFCO will not issue jadeite report using the terme "Type A jadeite" but state "no indication of color enhancement".

Shall GFCO SWITZERLAND be unable to issue a report for whatever reason, the laboratory will not charge any testing fees. However, all shipping & insurance costs shall be supported by the client.

The laboratory only accepts orders placed online and delivery by post/carrier.

Submission of the online order form signify acceptance of the General Conditions stipulated thereafter.

GENERAL CONDITIONS OF ANALYSIS BY GFCO GEM LAB® SWITZERLAND / GEAFINCO SA (THEREAFTER “GFCO-CH”)

1. Field of application

The present General Conditions apply to the contractual relations (here-after referred to as the contract) between GFCO-CH and the client as per the front side order form, subject to express derogatory stipulations. Clients are obliged to submit an GFCO-CH Order Form together with shipped item(s). They also apply if client is deemed to know its contents, namely by virtue of preceding orders.

2. Prices and payment conditions; default

The fees are defined in the price list as provided to client and available on the gfco.ch website at the time of order. Prices are stipulated in CHF including VAT. Invoices are payable within 30 days net. Any amount unpaid at due date bears interests at a rate of 50% p.a. Further, client owes CHF 25.- per correspondence caused by its default, as well as the costs incurred through the intervention of a collection agent, without prejudice of damages exceeding this amount. GFCO-CH is free to claim advance payment at any time, and to withhold contract performance until such payment is made. In such event delivery terms are deemed to be extended accordingly. GFCO-CH reduced rates are ad personam, non-transferable and to be paid on an annual basis.

3. Method of analysis, restrictions

GFCO-CH shall carry out the analysis according the methods described at gfco.ch website at the time of order - namely testing with standard equipment only which means whenever applicable: refractive index, specific gravity, microscope observation with 80X magnification, visual eye spectrum 400-700nm, polariscope, pleochorism and others tests with classic gemological equipment. Upon request for the testing of chemical elements such as presence of copper, vanadium, etc., GFCO-CH may use auxiliaries or subcontractors in the course of contract performance, the client agrees not to hold GFCO-CH liable for any consequences. Unless client informs GFCO-CH that an item submitted has already been tested before, it will be considered a new submission. Rechecks of a tested item, e.g. after recut, are invoiced at recheck rates. It is possible that a later re-examination of the Gemstones may lead to different results, should the applicable scientific standards for the examination change subsequent to the examination of the Gemstones by GFCO-CH.

4. Scope of analysis, restrictions

Client is free to provide GFCO-CH with any extra information than the ones required in the order form. GFCO-CH will consider any extra information regarding identification, trade name, treatment and origin as indicative and proceed to the creation of a gem identification report based on the result of testing and the instruction given by client. GFCO-CH may not mention all types of treatments that may have been applied to or used with respect to the Gemstones under examination. The fact that a particular method or treatment is not specifically mentioned in a Report does not mean that such treatments or methods were not used with respect to the particular Gemstone. Any remarks concerning the presence or absence of any treatment type or method are solely the expression of the findings made by GFCO-CH.

5. Transport, risk, insurance

All object risks related to the gemstones submitted to GFCO-CH, during transport and custody by GFCO-CH including shipment to sub-contractors, are at the client’s charge and must be insured to full value. Idem for transport fees, customs and insurance, as well as cost and administrative inconvenience induced by foreign legislation in case of contract performance abroad. Client shall refund any such costs if incurred by GFCO-CH. Client who does not have appropriate all-risk insurance coverage (not covering transport) can request this through GFCO-CH (acting as intermediary not as insurer) at an additional charge. All risk of potential damage to the gemstones, pearls or jewellery during unmounting is borne exclusively by the client. GFCO-CH assures that these services are conducted by experienced and trained professionals only.

6. Delivery, control at receipt

Delivery terms agreed upon are deemed to be non-binding, but GFCO-CH shall inform client if a fixed deadline cannot be kept. It is up to client to examine the item and to claim possible defaults though written notice specifying the grievances within 5 business days from receipt of the shipment.

7. Warranty & Liabilities

GFCO-CH guarantees careful contract performance within the scope of analysis and its limits, according to testing methods specified at the website and in the report and gemmological science. In the occurrence of a warranty claim GFCO-CH is not liable for damages incurred by client or third parties, be it direct, indirect, consequential or punitive, material or immaterial, based on contract, statute, tort or otherwise. Any action or exception based on warranty must be brought in within 15 days from receipt of the report, under pain of being forfeited. Other warranties, expressed or implied, are expressly ousted.

Reports and Opinions represents the opinion of at least one accredited gemologist about the Item at the time of examination; The Company, The Laboratory and The Operator cannot have knowledge of any potential subsequent treatment or modification of Items. Reports and Opinions are issued without any guarantees. Neither The Company nor The Laboratory nor The Operator shall be liable for any mistakes or omissions. The use of Reports and Opinions for trading by The Client are at his own risk. Neither The Company nor The Laboratory nor The Operator shall be liable for a failure of the system for the online checking of The Reports or the failure to keep record of the issued Reports. The maximum cumulated liability of The Company, The Laboratory and The Operator shall not exceed USD 5000 (FIVE THOUSAND UNITED STATES DOLLARS) in case of loss or theft of Items. In case of proven gross negligence or illegal act of a Company employee or a Laboratory employee or an Operator employee, The Company, The Laboratory and The Operator reserves the right to sue The Guilty Employee and only this last one shall be liable toward The Client. Neither The Company, nor The Laboratory nor The Operator, nor their employees shall be liable for any damages to Items while proceeding to standard testing of Items. It is The Client responsibility to insure Items for the duration these last ones are being given for testing to The Laboratory.

8. IX. Intellectual Property

Intellectual property such as invention patents, know-how, trade secrets in relation to gemmological testing and analysis, or copyrights and confidential information in relation to the contract are GFCO-CH’s exclusive property. All data, including but not limited to gemmological, photographic, geological or chemical data, which is gathered during the analysis of any Gemstones remains the sole property of GFCO-CH and may be freely used for scientific research and publication purposes by GFCO-CH. Client respects this intellectual property and refrains from any action contrary to the GFCO-CH’s appropriation or fruition thereof.

9. X. Applicable Law, Mediation and Arbitration This contract is subject to Swiss Law. In case of any dispute arising from or involving this contract, parties shall try Mediation according to Rules of the SWISS CHAMBERS. If the dispute cannot be settled within 15 days from inception of Mediation, it shall be referred to the court of Tramelan and both procedures can be conducted in French.
